Terms and Conditions

Please read carefully the general contracting conditions applicable to all bookings made with PEROU MAGIQUE TOURS E.I.R.L. By booking with us, you explicitly accept the policies described below.

1. Bookings, Rates and Payments

All bookings are considered confirmed once the confirmation deposit is received and our formal travel order is issued.

• Payment Currency: Rates expressed on our platform and custom proposals are quoted in US Dollars (USD). Payments in local currency (PEN) will be calculated using the official exchange rate of the transaction day.
• Guarantee Deposit: To secure train blocks, entrance tickets to Machu Picchu, and itineraries with premium hotels, an initial deposit equivalent to 50% of the total quote is required. This payment is non-refundable due to the rigid policies of local regulatory bodies (Ministry of Culture, PeruRail/Inca Rail).
• Final Balance: The remaining balance must be settled no later than 30 days before the itinerary starts, unless a different period is agreed upon in writing.

2. Cancellations, No Shows and Refunds

Cancellations must be formally notified in writing via email. The scale of penalties is governed by the following table:

• Cancellation more than 45 days in advance: Loss of the initial guarantee deposit. The remaining balance (if already paid) will be refunded, deducting applicable bank commissions.
• Between 44 and 30 days in advance: Penalty of 70% of the total value of the contracted tour package.
• Less than 29 days or No Show: Penalty of 100% of the trip value (no right to refund).

Note: Issued entrance tickets to Machu Picchu and train tickets do not allow refunds or name changes under any circumstances, in accordance with current regulations.

3. Itinerary Alterations and Force Majeure

<strong>PEROU MAGIQUE TOURS</strong> acts as an organizing intermediary between passengers and direct service providers (airlines, hotels, train companies).

We are not responsible for delays, schedule changes, flight cancellations, strikes, road closures, natural disasters, or extreme weather conditions that alter the planned itinerary. Under such circumstances (Force Majeure), we will assist clients to reschedule activities or relocate services, without assuming financial cost increases generated by such unforeseen events.

4. Recommended Travel Insurance

It is an indispensable requirement for adventure travel or high-altitude Andean routes that each passenger holds a valid international travel insurance. This insurance must adequately cover:

• Emergency medical expenses and hospitalization.
• Emergency medical evacuation.
• Involuntary trip interruption or cancellation.
• Loss of or damage to baggage and valuable personal items.

5. Client Obligations and Conduct

The traveler is solely responsible for carrying updated and perfect-condition identity documents (passport with a minimum validity of 6 months, or national ID as applicable) and complying with current migratory or sanitary requirements for entry into Peru.

Likewise, the client agrees to respect the regulations for the conservation of cultural and environmental heritage of the visited areas, refraining from reckless behavior or actions that violate public order.

6. Jurisdiction and Applicable Law

For any discrepancy or controversy arising from the interpretation and execution of the tourist services contract, the parties explicitly submit to the jurisdiction of the laws of the Republic of Peru and the courts of the city of Cusco, Peru.
